Privacy Policy

This Privacy Policy defines the general terms for the processing and protection of Users’ personal data that are collected in the course of receiving services from the Service Provider and using the Website.

1. General Provisions

1.1. Before registering on the Website and/or making payment for the services of the Service Provider, the User must read the provisions of this Privacy Policy and give their explicit consent to the processing of their personal data.

1.2. By filling out a special form on the Website and clicking the “Sign up” button (or a button with another name that has a similar meaning), the User hereby agrees to the terms of this Privacy Policy and consents to the processing of their personal data. The User’s consent to the processing of their personal data may be expressed by conclusive actions, in particular by continuing to use the Website after the User has had the opportunity to read this Privacy Policy.

1.3. The User must immediately stop using the Website if they do not agree with the terms of this Privacy Policy.

1.4. The owner and controller of personal data under this Privacy Policy is the Service Provider.

2. Definitions

2.1. The terms and concepts used in this Privacy Policy are used in the following meanings:

Website – a set of data (texts, graphic and design elements, photos, videos and other results of intellectual activity, computer programs) that are interconnected, contained in an information system, provide the availability of this information for end users, and are hosted at: https://boon.band.ua/.

User – an individual who uses the Website.

Service Provider – an individual entrepreneur who provides services to Users in the manner and under the conditions set out in the Public Offer Agreement, and who is also the owner and controller of Users’ personal data.

2.2. The headings of this Privacy Policy are provided for convenience only and do not affect the interpretation of its provisions.

2.3. If this Privacy Policy uses terms and concepts that are not defined in this section, such terms or concepts shall be interpreted in accordance with the text of this Privacy Policy. If there is no unambiguous interpretation of a term or concept, it shall be interpreted based on the generally accepted rules for understanding such terms and concepts on the Internet.

3. Data That May Be Collected

3.1. The following information about the User may be collected in accordance with this Privacy Policy:

3.1.1. Information received from the User, in particular:

  • full name of the individual;
  • phone number;
  • email address;

3.1.2. Information received during the use of the Website, in particular:

  • Cookies files;
  • User’s IP address;
  • User’s behaviour on the Website.

3.2. The Service Provider may automatically collect the User’s non-personal information, that is, information that does not allow the User to be directly or indirectly identified, including information about the User’s browser type or information about the website from which the User was redirected to the Website.

4. Purpose of Processing and Retention Periods of Personal Data

4.1. The User’s last name, first name, patronymic, phone number and email address are collected for organizing and implementing cooperation between the User and the Service Provider, in particular for the provision of services by the Service Provider to the User.

Such information is stored for three years after the last payment for the Service Provider’s services.

4.2. The User’s email address and phone number are collected for the exchange of information with the User, including for providing the User with marketing information about the Service Provider’s activities.

The User has the right at any time to refuse to receive SMS messages and emails containing the information specified in this clause.

4.3. Information about Cookies files, the User’s IP address and the User’s behaviour on the Website is collected to adapt marketing and advertising activities offered on the Website or on third-party services and to monitor the overall and individual activity of Users.

Such information is stored for three years after the User’s last visit to the Website.

4.4. The Service Provider does not collect or process the User’s payment data. Such collection and processing are carried out in accordance with the internal documents of the partner payment system and/or partner bank.

5. User’s Rights

5.1. The User has the right to:

5.1.1. know the sources of collection, the location of their personal data, the purpose of their processing, the location or place of residence (stay) of the owner or controller of personal data, or to give the appropriate authorization to receive such information to authorized persons, except in cases established by law;

5.1.2. receive information about the conditions for granting access to personal data, including information about third parties to whom their personal data are transferred;

5.1.3. access their personal data;

5.1.4. receive, no later than thirty calendar days from the date of receipt of the request (unless otherwise provided by law), a response as to whether their personal data are being processed, and also receive the content of such personal data;

5.1.5. submit a reasoned request to the owner of personal data objecting to the processing of their personal data;

5.1.6. submit a reasoned request for the change or destruction of their personal data to any owner and controller of personal data if these data are processed unlawfully or are inaccurate;

5.1.7. protect their personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, failure to provide them or untimely provision, as well as protection from providing information that is inaccurate or that discredits the honour, dignity and business reputation of an individual;

5.1.8. lodge complaints regarding the processing of their personal data with the Ukrainian Parliament Commissioner for Human Rights or with the court;

5.1.9. use legal remedies in case of violation of the legislation on the protection of personal data;

5.1.10. make reservations regarding the restriction of the right to process their personal data when giving consent;

5.1.11. withdraw their consent to the processing of personal data;

5.1.12. know the mechanism of automatic processing of personal data;

5.1.13. be protected from an automated decision that has legal consequences for them.

5.2. A User who intends to exercise their rights provided for in clause 5.1 of this Privacy Policy shall send their request to the email address: hello@boon.band. Such a request is considered by the Service Provider within 10 days from the moment of receipt.

6. Access to Personal Data by Third Parties

6.1. Users’ personal data may be transferred to third parties in the following cases:

6.1.1. upon the User’s written consent;

6.1.2. in cases provided for by the current legislation of Ukraine and this Privacy Policy;

6.1.3. when it is necessary to transfer data to the Service Provider’s partners (counterparties, etc.) for the purpose of carrying out transactions (fulfilling obligations) related to the User.

6.2. The Service Provider reserves the right to provide anonymized data to any third parties.

7. Other Provisions

7.1. The Service Provider has the right to unilaterally change the terms of this Privacy Policy without notifying the User. Changes to the Privacy Policy take effect from the moment they are posted on the Website.

7.2. If any of these Rules is found invalid by any competent state authority of Ukraine, this shall not affect the validity or enforceability of any other provisions of these Rules, which remain fully valid unless otherwise provided by the legislation of Ukraine.

7.3. Disputes arising between the Parties regarding the performance of these Rules shall be resolved through negotiations.

7.4. Disputes between the Parties that are not resolved through negotiations shall be settled by a competent court of Ukraine in accordance with the procedure established by the procedural legislation of Ukraine.
